Situations that warrant a divorce:

Hawaii Divorce law has a adopted a “no-fault divorce” analysis when determining whether or not to grant a divorce. As a "no-fault" divorce state, a person seeking a divorce in Hawaii must factually establish one of the four possible grounds for divorce listed below:
• The marriage is permanently broken.
• The parties have lived separately under a decree of separation, the term of separation has ended, and the parties have not reconciled.
• The parties have lived separately for two years or more under a decree of separate maintenance, and the parties have not reconciled.
• The parties, preceding the application for divorce, have lived separately for two years or more, and there is no likelihood that cohabitation will resume. Additionally, the court must be satisfied that it would not be harsh, oppressive, or against the public interest to grant the petitioner’s application for divorce.

Divorce Options

In Hawaii, there are essentially two ways to get a divorce:

1. Uncontested Divorce: This occurs when both parties agree on all aspects of the divorce, including division of assets, custody, and support. The agreements are drafted into a decree, which is then finalized.
2. Contested Divorce: If there are unresolved issues, the case will go to trial. A judge will make decisions on the contested issues, which will be incorporated into the final decree.

We offer a FREE initial consultation to provide you with practical, strategic, and realistic advice tailored to your situation, whether you're facing an uncontested or contested divorce. Contact us to start the process and get the support you need.

Uncontested Divorce

An uncontested divorce occurs when both spouses agree on all terms of the settlement, with no disputes remaining. This includes arrangements for child issues (such as custody, visitation, and child support), alimony or spousal support, and the division of property and debts.

In an uncontested divorce, our role as your Family Law Attorney is to handle the stress and responsibility of processing and filing your uncontested divorce for you. We prepare all necessary Hawaii divorce forms, coordinate signatures from both parties, file the documents with the court, and secure the Family Court Judge's signature on the divorce decree. This process is typically less costly than a contested divorce and is usually completed in under a year.

Contested Divorce

A contested divorce arises when spouses cannot agree on one or more terms of their divorce. Disputes may involve property division, alimony, child timesharing schedules, child support, and more.

Representing yourself in a contested divorce can be challenging, especially if the other party has legal representation and you lack familiarity with divorce law and Hawaii Family Court procedures. For the best results, it's crucial to have experienced lawyers by your side. Our team of seasoned divorce litigation attorneys is dedicated to representing you with zeal and integrity, striving to achieve the best possible outcome for your case.
